[TWC] Slow Speeds SoCal

Hey guys...I just wanted to say Thank You beforehand for any repsonses I get. It is a bit of a read, but the way I see it...the more I am detailed now the quicker I can get to my resolution if possible. My current situation:

I have TWC/RR Turbo cable service since December 2008. It has been at least 6 months since I have this issue, but the occurance has started to become annoying. It is a complete new line from the distribution to my house.

Approximately form 9PM to 1AM, my connection is really bad. I have tried speedtest.net and speakeasy.net to test speeds and ping (200ms+). The rest of the day it works GREAT!!!

I have called in tech support and I have done all the trace route, speed test, etc. Tier 2 support confirms that there is a problem. I have tested my own modem (Motorola SB5120) and the TWC/RR modem (RCA DCM315) that came with the service resulting in the same slow internet for both.

I was then issued an appointment with the tech service. They came to test my line which turns out to be good. The signal is a bit high so a "EQ" was installed. But since my problem is at night, they can't do anything about that because no one works at that time. So they get in contact with the maintenince person in my area and called in to have my line/node monitored. The maintenince checked all the lines and nothing seems to be wrong. I was later informed that during the night when my issue occurs, all the modems in my node are pinging fine except for me.

Again, the maintenince checks all the lines routing to me and changed the "faceplace" where the service is distributed to my house; and tells me that is the last thing he can do.

So I right on the edge of changing services if this continues. I am paying for their best service I expect to be satisfied 99.99% of the time. Anyone have any suggestions or any ideas to approach this problem. Maybe even get a discounted price if the problem cannot be fixed.

Note:
1st
Normally I am on a router, but during all the testing it has been the modem directly to my PC.

2nd
My speeds are around 1-2mbps down and 1mbps up

Thanks.
