Sweden's New Piracy Law Foiled By ISPs

Sweden's new Intellectual Property Rights Enforcement Directive (IPRED) anti-piracy law went into effect last week, the new law giving copyright holders in Sweden the ability to force ISPs in the country to hand over the names and addresses of users who transmit pirated material. But as it turns out, the concept is being foiled not by pirates, but by ISPs. Since preservation of IP addresses is entirely voluntary under the law for ISPs, at least one ISP is deleting consumer IP data so they don't have to hand it over to the entertainment industry:
"It's about the freedom to choose, and the law makes it possible to retain details. We're not acting in breach of IPRED; we're following the law and choosing to destroy the details," Karlung told news agency TT. Bahnhof's actions render the IPRED law entirely ineffective when dealing with file sharers signed up to the company's broadband service. Karlung noted that the law would have no effect whatsoever if other ISPs were to follow suit.
Of course the next step will be for Swedish lawmakers to pass laws requiring ISPs retain data for a set length of time -- something they're already working on.

Sweden's Gov is Stupid

All they did with this new law is protect criminals.

Now when they need to trace an IP for a real crime, the ISP will say sorry we do not have that info since you forced us to deleted all ip info so we did not have to get involved with the filesharing issues.

I suspect Sweden knew exactly what they were doing when they passed this law. It pleases both sides.

Other network abuse?

That's great as long as you don't have any wannabe computer crackers on there or infected machines spewing spam. They might want to rethink how they are handling this.

Don't worry. The law coming next requiring ISPs to save data for 6 months will solve that problem. And the ISP CEO making a big noise about destroying IP data says he will comply with the retention law.

Data retention laws are expensive and could hurt privacy

Governments and individuals tend to use and abuse data collected, even when they aren't supposed to. I don't want to have some schmo looking through my ISP records to embarrass me in some message board argument. If I did anything embarrassing, of course ;)

Someone has to pay for the data retention, and it's either going to be the consumer through higher fees, or the taxpayer who subsidizes it.

Do they really need to destroy the data? Couldn't they just disable the logs that keep track of that data? Thereby never leaving anything to destroy in the first place?

Right. Because being able to associate an IP address with an individual has been proven bulletproof in their identification of the real criminals. It's also done wonders to stop child pornography. And 411 scams. And counterfeit drugs. And ponzi schemes. And identity theft. And all of the hundreds of other illegal activities done online.

And just to remove all doubt, yes, that was sarcasm in my post above.

If I viewed it as a cost ...

Why should I jack up my manpower and equipment costs keeping detailed logs for an industry that attacks my customers and for which services I will not be paid for?

If I was in that position, and like a well run business, wanted to limit my costs, I wouldn't destroy anything.

I'd just never log most of it in the first place.

The filthy rich are so powerful they can now enforce laws to protect their 'properties' on a global scale! They now have power to stop people all over the world from sharing with their friends what was legally bought in the first place! Its like saying "why did you share your mango with all these other people?" Its forcing by law everybody to buy a mango from the stalls and not share with others! It is a new global law saying: " Do not plant a mango seed from the mango you bought from the stall!" Now every time you need a mango you must buy from the first person to claim a patent over a particular type of mango!? The world is going bananas!
